By signing up for any account with Paperless Forms, whether paid or the Free Forever plan, you are agreeing to abide by these Terms. This is a legal agreement. First, let’s set out some terms that will be used throughout these Terms of Service:
Paperless Forms is an online form building service available at www.paperlessforms.com. We will refer to that website as “Website” and to the Paperless Forms form building software as the “Service” or “Paperless Forms”.
Paperless Forms allows you to design, create, publish, and use online forms (your “Forms”) which you can share using many methods, including a URL link and HTML embed code; you may also manage, store, and process the data gathered by completed forms “submissions”.
Each Paperless Forms account includes one admin license (“License”) which entitles one individual (“User”) to access that account to build forms, edit forms, and access data from completed forms. If you require additional Users for your account, you must purchase additional licenses (“User Licenses”) at an additional monthly fee.
Paperless Forms has employees and highly specialized contractors, whom we call our (“Team”).
Paperless Forms is owned and operated by Paperless Forms Inc, a Michigan C-corp headquartered in Southfield, MI. (“Paperless Forms,” “we”, or “us”)
Paperless Forms reserves the right to refuse service, close accounts of any users, and change eligibility requirements, at any time, at our discretion. By choosing to create an account on Paperless Forms, you agree to the following:
You may close your account at any time, for any reason. When you close your account, your forms and data gathered from form submissions will be permanently deleted. It is not stored on our servers, and it can’t be recovered.
We reserve the right to pause or delete your account, at any time, with or without cause. If we close your account without cause, we may refund a prorated portion of your monthly subscription fee. If we close your account with cause, including but not limited to violating these Terms, we will not issue a refund.
If you have a Free Forever Account and don’t log in for 6 or more months, we may treat your Account as “inactive” and permanently delete the Account and all the data associated with it.
We appreciate your trust and take the security of our form building software and your data seriously.
We work hard to keep your information safe and secure. Please do your part and protect your account login name and password. You are responsible for any account that you have access to. We will not take responsibility for any data losses or problems arising from unauthorized use or stolen or hacked passwords.
If you feel like the security of your account has been compromised, please contact us immediately at email@example.com so we can take protective measures to safeguard your information.
Our office is located in the United States. We have 2 dedicated servers in the US (Lansing, Michigan and Phoenix, Arizona) and 1 in Europe (Amsterdam). These operate on a redundancy system to ensure robust, reliable service with no downtime or lost data. Our technology is ISO certified and compliant with top global standards for privacy and security, including SSAE-16, HIPAA, PCI-DSS, ISAE 3402, and AMS-IX. While we take reasonable and appropriate measures to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, understand there are still risks involved when using a digital software product.
If a security breach causes an unauthorized intrusion into our system that materially affects the information in your account, we will notify you as soon as possible and later report the action we took in response.
You are responsible for securing account names, login emails and passwords. We will not resolve disputes over which individuals in an organization have access to an account.
You may change your password at any time from the Edit Profile section when you are logged in. If you don’t remember your password, you may reset it by clicking on Lost Password in the login window. A reset link will be sent to the primary email address attached to your account. If you can’t remember what email was used to create the account, please contact us and we will do our best to help. However, we will not manually update the email address or change profile information on an account.
Each form you create using Paperless Forms is yours, meaning that we will not copy, sell, or share your created forms with anyone.
We consider the data collected using your forms to be private, meaning we will not copy, sell, or share the data you collect with any other party.
However, we assert the right to control content and access to our software. We reserve the right to delete content and accounts if there is reason to suspect that laws are being broken, fraud is being committed, the content violates the rights of others, or these terms of service have been violated. Additionally, we may disclose your personal information in these circumstances:
Fees for Paperless Forms is listed on our Pricing page and may change from time to time. You will be notified ahead of time by email if there are any changes to our pricing structure.
Charges for your account level will be made each month on the credit card added to your account. The billing cycle is monthly, on the day of your plan. For example, if you join a paid plan on the 11th of the month, then your account will be charged on or around the 11th of each month.
If you upgrade your plan during your billing cycle, the pro-rated additional cost for the remainder of your billing cycle will be charged to your payment method immediately.
If you downgrade your plan during your billing cycle, a credit for the remainder of your billing cycle will be credited to your account.
Refunds are not issued.
If your payment method is declined for any reason, you will be notified immediately. If an updated payment method is not provided and a balance remains outstanding, your account will be locked approximately 7 days after payment failure. For example, if your billing cycle is on the 11th and payment fails, your account will be locked on or around the 18th. The locking of your account does not constitute cancellation of your account and/or any outstanding fees.
Each individual, business, or organization may only have one Free Forever account.
See our Pricing page for details of plan limits on the number of forms, fields, and submissions. These plan limits may change from time to time.
If your account exceeds the limits of your plan, it will affect your use of Paperless Forms. This may include forms locking and not accepting new entries, not being able to create new forms, or not being able to add more fields to a form.
If your use exceeds the limits of your plan, we recommend you upgrade your plan.
At our sole discretion, we may modify these Terms of Service at any time, for any reason, including changes in technology, business practices, or legislation. We also reserve the right to change our form building software, features, account levels, pricing, and anything else relating to our Website and Service.
Any change which materially impacts your use of your Paperless Forms account will be sent to you directly via email to the address on your account. Following notice of such changes, your continued use of your Paperless Forms account, shall indicate your acknowledgement of such changes and your agreement to be bound by the updated terms and conditions of such changes.
